The trail of the man accused of killing six and injuring two during a shooting spree on Feb. 20, 2016 has been temporarily stalled.
Jason Dalton, the Uber driver being tried for the shooting, had his trial scheduled in Kalamazoo’s Ninth Circuit Court on June 13, 2017. On May 8, Dalton’s defense attorney Eusebio Solis made a motion to have Dalton’s statements to police to be suppressed, according to public records related to the case.
Judge Alexander Lipsey denied the motion, but put the trial on hold while the decision was appealed by attorney Anastase Markou in the Michigan Court of Appeals, according to the court’s records.
The appeal aimed to “examine whether interviews conducted by police with Dalton violated certain rights set forth by the Fifth and Sixth Amendment of the Constitution" while interrogating him, Markou said in a press release dated May 19, 2017 from the law offices of Levine & Levine.
Markou filed the appeal on June 14 and the appellate court denied it on Sept. 18, 2017, according to a record from the Michigan Court of Appeals.
Now, the case has been taken to the Michigan Supreme Court which will decide whether or not it will consider the appeal, according to Kalamazoo Assistant Chief Prosecutor Scott Brower.
A status review for the case is currently set for Friday and if a decision is made by then, the judge would likely set a date for the trial to resume. If the Supreme Court hasn’t made a decision by Friday, however, another status review will be scheduled.
Brower said he believes it is “probably unlikely” that the court will decide to hear the appeal.
